Summary

The Prosecutor plays a crucial role in upholding justice and maintaining the legal system within the Cocopah community. This position is responsible for representing the tribal government in criminal and civil cases, ensuring the fair administration of justice, and advocating for the interests of the tribe. The tribal Prosecutor works collaboratively with law enforcement, tribal leaders, and other stakeholders to uphold the rule of law within the Cocopah jurisdiction.

Essential Duties and Responsibilities:

Prosecute criminal cases on behalf of the tribe, including but not limited to cases involving misdemeanors, felonies, and juvenile offenses.Represent the tribe in civil matters, including contract disputes, tribal ordinances violations, and land-related issues.Conduct thorough investigations, gather evidence, interview witnesses, and collaborate with law enforcement agencies to build strong cases.Review police reports, evidence, and witness statements to determine the strength of cases and legal strategies.Appear in tribal court and present cases effectively, including preparing and delivering opening statements, examining witnesses, and making closing arguments.Ensure that all legal proceedings adhere to tribal laws, regulations, and procedures.Stay informed about relevant tribal laws, federal laws, and legal precedents to effectively represent the tribe's interests.Provide legal opinions and advice to tribal leaders and departments as needed.Collaborate with law enforcement agencies, tribal social services, and other relevant departments to address community safety and legal issues.Communicate regularly with tribal leaders and the general counsel to discuss legal matters and strategies.Engage with the tribal community to provide education about tribal laws, rights, and responsibilities.Promote conflict resolution and mediation as alternatives to litigation where appropriate.Maintain accurate records of cases, including case files, evidence, and legal documents.Generate reports on case outcomes and legal activities for tribal leadership and federal agencies, as required.Represent individuals who want restraining orders.Enforce child support judgments.Researches and prepares grants for the Prosecutor?s office.Other duties may be assigned.

    Knowledge, Skills and Abilities

    Strong knowledge of tribal laws and sovereignty, and understanding of federal and state laws impacting tribal jurisdiction.Excellent communication, negotiation, and interpersonal skills.High ethical standards and a commitment to upholding justice within the tribal community.Ability to present statements of law, facts, and arguments clearly and logically.Knowledge of trial procedures and rules of evidence.Ability to interpret statutes, case histories, and various laws.Ability to exercise judgment and discretion in decision-making; preferred.Knowledge of Native American culture and traditions.Ability to establish and maintain effective working relationships with employees, various tribal offices, and the public.

      Qualifications

      Must possess and maintain a valid Arizona driver?s licenseMust never have been convicted of a felony in any tribal, state, or federal court.Must be able to pass background and fingerprint checks.

        Education and/or Experience

        Juris Doctor (J.D.) degree from an accredited law school.Admission to practice law in the tribal jurisdiction or the ability to obtain tribal bar membership promptly.At least 5 years of experience in criminal and civil litigation, with preference for candidates with tribal law experience.
