Construction Litigation Attorney

Donahue Fitzgerald, LLP is seeking a highly experienced and motivated Construction Litigation attorney to join our dynamic team. This position is open to candidates at either the Partner level or as a Senior Associate with a clear path to partnership, depending upon experience and book of business. We are a well-established, mid-sized East Bay law firm with a strong reputation for excellence in construction law, representing a diverse range of clients, including developers, contractors, subcontractors, design professionals, and owners.

Job Duties

• Lead and manage all phases of complex construction litigation, including pre-litigation dispute resolution, discovery, motion practice, mediation, arbitration, and trial.
• Provide strategic legal counsel to clients on a wide array of construction-related matters, including contract disputes, delay claims, defect claims, payment disputes, and professional liability.
• Conduct thorough legal research and analysis, prepare persuasive legal briefs, and deliver compelling oral arguments.
• Develop and maintain strong client relationships to ensure exceptional service and effective communication.
• Mentor and supervise junior attorneys and legal support staff.
• Actively participate in business development initiatives to expand the firm?s client base and enhance its market presence

Knowledge and Skills

• JD degree from an accredited law school
• Must be a member in good standing with the California State Bar
• 7+ years of litigation background with extensive experience in construction defect and construction disputes, real estate defense litigation, contract law, and insurance coverage
• Proven track record of successfully litigating complex construction disputes to favorable outcomes
• Excellent legal writing skills for drafting legal documents, correspondence, and reports
• Must be detail-oriented
• Must be a self-starter with superior organizational skills and the ability to manage multiple assignments from start to finish independently
• Strong analytical and research skills
• Ability to mentor and supervise associates and build strong relationships
• A portable book of business is a plus

Total compensation for the Partner role is between $190,000 ? $380,000 annually. Compensation includes both the base salary and additional compensation that can be earned above the base salary from working attorney fees and origination fees from business originated by the Partner.

The salary range for the Senior Counsel role is between $190,000 ? $200,000 annually. In addition to the base, attorneys are eligible for a billable hours-based bonus upon meeting specified billable hours goals.
