Reporting to General Cousel, the Assistant General Counsel, will:

  • Provide guidance to field teams regarding resident concerns, including drafting default and demand letters and other related resident correspondence, negotiating and drafting resident and sales customer demand letters and settlement agreements, and handling initial resident default and eviction notifications.
  • Manage pre-litigation and litigation matters, while partnering with outside legal counsel on legal matters, including reviewing, developing, and implementing legal strategy in response to litigation, and managing outside counsel scope of work and fees.
  • Coordinate with insurance coverage counsel on insured matters to gather relevant information during pre-litigation assessment and throughout discovery proceedings.
  • Support day-to-day property operational issues, including negotiating public and private easements, property specific agreements, utility agreements, updating standard contracts and lien waivers, amenity service agreements, reviewing, understanding, and/or drafting residential lease provisions.
  • Review and negotiate vendor, service and other third-party contracts, broker listing agreements, and non-disclosure agreements.
  • Manage acquisition, disposition, financing and refinancing transactions, including review and negotiation of purchase and sale agreements, loan documents, and related transactional documentation.
  • Stay abreast of changes in laws and regulations and advise business team on new and existing laws and legal rights that impact business functions and operations.
  • Provide guidance to senior management on legal issues in situations involving political, public relations, or financial risk or significance, in a manner that balances risk with achievement of Company goals and objectives.
  • Partner with human resources team to provide consultation on difficult or sensitive team member issues involving employment law, workers compensation, government agency complaints and related matters.

To be successful in this role, Hometown America looks for the following attributes and/or transferable experience and skills acquired in a different industry or in a different context:


  • 5+ years of relevant legal experience in litigation or general practice demonstrating ability to work independently.
  • Strong written and verbal communication skills, with ability to communicate with all levels of the organization and with a variety of stakeholders.
  • In-house legal experience in real estate industry a plus.
  • Experience in real estate law, property management, and/or manufactured housing industry highly preferred.
  • Knowledge of range of applicable laws and regulations impacting all areas of the business and ability to provide competent legal advice and counsel to executive and senior management on a wide range of legal and policy issues.
  • Demonstrate sound business ethics, relate to others in a manner that builds trust and credibility, maintaining confidentiality.
  • Organized, with ability to independently manage multiple projects, while attending to details and deadlines. Strong analytical and problem-solving skills.
  • Juris Doctor (JD) from an accredited law school with proven academic success.
  • Active license to practice law and in good standing with Illinois Bar.
