Buchanan?s FDA Section seeks a highly motivated and experienced Associate with 5-8 years of legal experience in life sciences and healthcare litigation, arbitration, and administrative proceedings. The ideal candidate will possess a strong background in representing healthcare professionals and entities in complex business disputes, including litigation, arbitration, and administrative proceedings. This role involves handling a diverse range of matters related to pharmacies, healthcare providers, and third-party payors, with a focus on advocacy, regulatory compliance, and dispute resolution. Key Responsibilities: Represent healthcare professionals and organizations in complex disputes, including litigation, arbitration, and mediation. Manage cases involving specialty, retail, and compounding pharmacies, wholesalers/distributors, health plans, 340(b) covered entities, contract pharmacies, and other healthcare providers. Handle audit, reimbursement, and network access disputes with Pharmacy Benefit Managers (PBMs) and other third-party payors, including Medicare and Medicaid. Represent pharmacy and pharmacist clients in Board of Pharmacy (BOP) matters, including licensing, inspections, investigations, enforcement actions, and related regulatory issues across multiple jurisdictions. Advise and counsel clients on regulatory compliance, licensing, and administrative law issues. Develop and implement effective legal strategies tailored to the healthcare and pharmacy sectors. Draft and review legal documents, pleadings, discovery, and settlement agreements. Advocate for clients in federal and state courts, as well as in private arbitration and mediation settings. Stay informed about evolving laws, regulations, and industry practices affecting healthcare providers, pharmacies, and third-party payors. Collaborate with clients and internal teams to develop strategic solutions addressing complex legal and regulatory challenges. Qualifications: Juris Doctor (JD) from an accredited law school. 5-8 years of experience in life sciences and healthcare litigation, with a focus on pharmacy, healthcare providers, or related fields. Demonstrated experience in handling complex disputes, including arbitration, litigation, and administrative proceedings. Strong understanding of healthcare regulations, pharmacy law, and third-party payor practices. Proven ability to advocate effectively in various legal venues, including courts and alternative dispute resolution forums. Excellent analytical, research, and communication skills. Ability to manage multiple cases and deadlines efficiently. Bar admission in New Jersey and/or New York required; other state admissions a plus. Preferred Skills: Experience with Board of Pharmacy proceedings and/or other similar administrative board proceedings including medical boards, nursing boards, etc. Deep knowledge of PBM industry practices and the highly consolidated PBM marketplace. Experience representing clients in regulatory investigations, enforcement actions, and reimbursement disputes. Strong advocacy skills with an assertive litigation style. Familiarity with Medicare, Medicaid, and other government healthcare programs. Salary Range: $230,000 to $280,000 BAR ADMISSION REQUIRED: Must be admitted in state where office location is.
