Job Description


Provide legal support and guidance on a wide range of labor and employment related issues while contributing to maintain a compliant and effective workforce environment within the healthcare sector. This position reports to the Senior Legal Counsel representing management in labor and employment initiatives and collaborates within Human Resources and other internal and external stakeholders.
Description:


1. Employment Law Support:

a. Provide legal advice on employment related issues, including hiring, compensation, wage and hour, benefits, workplace discrimination, harassment, and retaliation, and personnel issues such as performance, discipline, termination, privacy, and workplace accommodations.

b. Assist in interpreting and ensuring compliance with federal, state, and local employment laws, including Massachusetts-specific employment laws.

c. Provide legal advice and assist in the development and implementation of employment policies and procedures.

d. Advise and assist Human Resources (HR) with internal employee relations complaints, investigations, decision-making, conflict resolution, and provide legal guidance on matters related to leaves and employee disability-related issues.

2. Labor Law:

a. Support labor relations efforts with the labor relations team, management, and union representatives in conducting impact bargaining, resolving disputes and handling grievances.

b. Advise and assist labor relations team with the interpretation, application, and administration of the terms and conditions of union collective bargaining agreements (CBA). Assist with the preparation and negotiation procedures of bargaining successor CBAs.

c. Assist with preparation and procedures for arbitration hearings, including case outlines, witnesses, and document production.

d. Advise on developments under federal labor law and by the National labor Relations Board.

3. Regulatory:

a. Ensure compliance with laws such as the Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), Occupational Safety and Health Administration (OSHA), Massachusetts Fair Employment Practices Act, Massachusetts Worker?s Compensation statute, and other laws regulating the employment relationship.

b. Assist in the preparation and review of legal documents and filing of reports.

c. Monitor developments in and changes to employment and labor laws to ensure relevant policies are updated accordingly.

4. Employee Relations:

a. Collaborate with HR and management on employee relations issues by providing guidance and recommendations for conflict resolution and establishing a positive workplace environment.

b. Participate in the training and education of staff on organizational policies and procedures related to labor and employment laws and internal processes.

5. General Legal Support:

a. Prepare documentation, including legal notices, subpoenas, submissions to administrative forums, courts, arbitrators, and other procedures as required.

b. Provide other legal support and research as needed to assist with regulatory compliance for employer in healthcare sector.

Qualifications:
  • J.D. (Juris Doctor) from an accredited law school.
  • Admission to the Massachusetts Bar (or ability to become admitted promptly).
  • Three plus years as an attorney, preferably in a law firm, corporation, healthcare, or government setting.
  • Experience with a focus on employment law and/or labor law, employee relations, labor relations, and collective bargaining is preferred.
  • Strong understanding of federal, state, and local employment and labor laws, including Massachusetts-specific regulations.
  • General knowledge of procedures before federal and state agencies, including Equal Employment Opportunity Commission (EEOC) and
  • Massachusetts Commission Against Discrimination (MCAD).
  • General knowledge of civil litigation procedures.
  • Strong written, speaking, and interpersonal communication skills.
  • Strong analytical, investigative, and problem-solving abilities.
  • Ability to facilitate and lead discussions.
  • Ability to independently perform multiple tasks and prioritize effectively in a fast-paced environment.
  • Ability to work collaboratively with a variety of stakeholders, including leadership, HR, management, and external partners.
  • Experience with HRIS, legal research, and Microsoft Office Suite.
  • Detail-oriented lawyer with a commitment to accuracy and thoroughness.
  • Proactive, with strong organizational and time management skills.
  • Maintain confidentiality as required and appropriate.
  • Demonstrate sound judgment and professionalism.
