The Early Childhood Education and Care Department was established on July 1, 2020. The Department's aim is to create a more cohesive, equitable, and effective early childhood system in New Mexico. That means coordinating a continuum of programs from prenatal to five, and ensuring that families in every corner of the state can access the services they need.
This posting will be used to conduct ongoing recruitment and will remain open until position has been filled. Applicant lists may be screened more than once.
Why does the job exist?
The Assistant General Counsel will handle a wide array of legal work and assist the other attorneys in the agency's Office of General Counsel with various tasks. This work may include, but not be limited to, litigation, administrative hearings, employment matters, contract development and reviews, and legal research on any issue affecting the agency. The Assistant General Counsel will also work with other members of the agency's Office of General Counsel and staff to draft, review, and prepare proposed legislation or regulation amendments. This position will also handle issues dealing with a variety of federal regulatory compliance requirements.
How does it get done?
This position will work on litigation involving or affecting the agency, administrative hearings, employment matters, contract development and reviews, and legal research on any issue affecting the agency. The Assistant General Counsel will also draft, review, and prepare proposed legislation or regulation amendments and handle issues dealing with a variety of federal regulation compliance requirements, including Individuals with Disabilities Education Act (IDEA), federal Health Insurance Portability and Accountability Act (HIPAA), New Mexico Inspection of Public Records Act (IPRA) and the Criminal Justice Information System (CJIS) for purposes of background checks. The Assistant General Counsel will provide legal advice or determine legal strategy on cases (both litigation and rulemaking), draft, review, and prepare critical proposed legislation, reports, correspondence and other documentation for the various divisions and staff in the area of program administration.

Minimum Qualification
Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA). Must possess and maintain a valid Driver's License. Pre-employment background investigation is required and is conditional pending results.
Working Conditions
Work is performed in an office setting with exposure to Visual/Video Display Terminal (VDT) and extensive personal computer and phone usage. Some sitting, standing, bending, and reaching may be required. Direct client interaction and some travel may be required.
