Job Description


Winstead PC is seeking 3+ year attorney for a position with our Business Litigation practice group in Dallas with Taylor White and our other litigation shareholders. This position is focused in Labor and Employment Litigation including advising and defending managers and employers in employment-related matters before state and federal courts, the EEOC, OSHA, and other state and federal agencies. The ideal candidate will have experience in the following areas: ? Labor and Employment Experience : Advising senior business leaders, HR professionals, corporate counsel and decision-makers on employment decisions and litigation avoidance; serving as a labor and employment subject-matter expert in corporate transactions, such as mergers and acquisitions; drafting and revising employee handbooks, offer letters, and other employment-related documents; drafting and revising restrictive covenant agreements; and drafting and revising independent contractor agreements. ? Litigation Experience: Representation of employers with respect to charges of discrimination before the EEOC and FEPA matters, to investigations by the U.S. Department of Labor or Occupational Safety and Health Administration, and to unemployment hearings; representation of employers in state and federal lawsuits involving claims for wage-and-hour violations and employment discrimination, harassment, and retaliation; and, representation of employers and employees in lawsuits involving claims for misappropriation of trade secrets, breach of fiduciary duties, and breach of restrictive covenant agreements. ? Writing skills: Candidates should be proficient at complex legal drafting of both litigation documents, such as briefs and motions, and transactional documents, such as contracts. ?
